Lightning on New Jersey Golf Courses: What Duty of Care Do Clubs Owe?

On Sunday, August 17, a golfer at a Florham Park course was struck by lightning during a sudden summer storm. Police arrived to find bystanders performing CPR before the victim was transported to a nearby hospital and placed in critical condition. This incident occurred less than a month after another golfer in Hardyston, NJ, tragically lost his life when lightning struck while on the course.

These back-to-back incidents have raised questions about whether golf courses are doing enough to uphold their duty of care and to keep players safe when severe weather approaches. For many, a golf course feels like a controlled environment where safety procedures are in place. When those systems fail or warnings are not given, the consequences can be devastating.

The Duty of Care for Golf Courses in New Jersey

Under New Jersey law, golf courses owe a duty of care to their players and guests. This means taking reasonable steps to protect against known or foreseeable dangers.

Lightning is not a new hazard; it’s a well-documented risk on golf courses because of wide-open spaces, tall trees, water features, and the use of metal equipment. In fact, the odds of generally being struck by lightning are 1:700,000, and the odds of getting stuck on a golf course are 1:3,000, making this a very serious and dangerous risk.

When a course chooses to implement safety systems such as lightning detection, warning sirens, or evacuation policies, it must use them consistently and correctly. Courts have held that once a safety protocol is adopted, players are entitled to rely on it. Ignoring or misusing these systems can amount to negligence. Ultimately, golfers trust that when they step onto the course, management has taken proper precautions to reduce risks. Failing to meet that standard can lead to preventable tragedies.

The duty of care extends beyond simply installing technology or hanging a sign. It requires active monitoring of weather conditions, effective communication with players, and a commitment to protecting people from preventable harm. In the Florham Park case, a golfer reportedly approached staff members to warn about the incoming storm and inquired if it was still safe to play. The response from the employee was “It’s not my problem.” In New Jersey, this duty of care includes more than simply having precautions in place; it requires active attention to safety.

Safety Measures Golf Courses Should Take

A golf course’s duty of care goes far beyond the weather. Courses must ensure that every part of their property and operations is reasonably safe for guests. Negligence can occur in many different areas, from storms to maintenance to daily operations.

Some of the most important areas where golf courses owe a duty of care include:

  • Weather Monitoring and Alerts – Reliable radar or lightning-detection systems, with clear protocols to suspend play and evacuate golfers when storms approach.
  • Evacuation Procedures – Audible sirens or horns, safe shelters that provide true lightning protection, and clear evacuation routes.
  • Golf Cart Safety – Proper maintenance of golf carts, functioning brakes and steering, safe charging and fueling practices, and enforcement of cart operation rules.
  • Course Maintenance – Regular inspection and upkeep of walkways, bridges, steps, and landscaping to prevent trip-and-fall hazards.
  • Water Hazards and Ponds – Fencing, signage, and reasonable barriers where needed to prevent accidental falls or drowning risks.
  • Equipment and Rental Safety – Clubs, carts, and other equipment provided to players must be safe and properly maintained.
  • Alcohol Service – If alcohol is sold, staff must follow responsible service practices to avoid overserving players who may then drive or operate carts unsafely.
  • Staff Training and Oversight – Employees must be trained to respond appropriately to emergencies, weather risks, and player concerns.

Golf courses are meant to provide recreation and enjoyment, but that enjoyment comes with a duty of care. When a course neglects its responsibility to the duty of care, serious injuries and even deaths can be the result. These are not extraordinary precautions but reasonable steps that a facility open to the public is expected to take.

Legal Complexities with Public Courses

In New Jersey, many golf facilities are owned by counties or municipalities but managed by private operators. The Florham Park course, where Sunday’s lightning strike occurred, for example, is part of the Morris County Park Commission system. When an incident happens on public property, strict rules under the New Jersey Tort Claims Act (N.J.S.A. 59:1-1 to 12-3) apply. Victims or their families typically have only 90 days to file a Notice of Claim. Missing this deadline can reduce the amount of compensation you can receive for your damages and losses, with very limited exceptions. For this reason, it is critical to act quickly when injured on a publicly owned course.

How an Experienced New Jersey Personal Injury Attorney Will Help

Although no amount of money can undo the tragedy of a lightning strike, a good lawyer can help obtain compensation to ease the situation.

The attorneys at Davis, Saperstein & Salomon, P.C. in Teaneck have helped more than 35,000 families recover over $1 billion in verdicts and settlements for clients and families affected by others’ negligence.

  2. $687,500 settlement – Trip-and-fall at a golf facility

Saperstein, Esq., has helped thousands of accident victims win settlements or verdicts in complex truck and bus accident litigation, construction site injuries, product liability cases, and diet drug litigation. Ridgewood Roofing Accident Highlights the Serious Risks of Workplace Injuries

Last week, Ridgewood police and emergency personnel responded to a report of a man who had fallen from the roof of a residence while on the job as a painter on Kenilworth Road. The painter, who was reported to be employed by a North Jersey-based painting company, was transported to Saint Joseph’s University Medical Center in Paterson with severe injuries. According to officials, representatives from the Occupational Safety and Health Administration (OSHA) also arrived at the scene as part of the standard review process following serious workplace incidents.

This tragic accident is a reminder of the dangers that construction and roofing professionals face every day. Under New Jersey law, when an individual suffers a workplace injury, they have the right to receive benefits, and families have the right to recover financial support.

At Davis, Saperstein & Salomon, P.C., the firm has helped more than 35,000 clients and their families get back on their feet after suffering workplace injuries, wrongful deaths, and other losses caused by others’ negligence. Their attorneys emphasize that families are entitled to grieve, feel anger, and seek justice, while having a trusted legal team handle the complex process of pursuing claims.

If you believe you have a case, you’ve come to the right place.

Workers’ Compensation in New Jersey

The New Jersey Workers’ Compensation Act (N.J.S.A. 34:15-1 et seq.) provides a no-fault system of benefits for employees injured on the job.

Key benefits include:

  • Medical treatment authorized by the employer or insurer.
  • Temporary disability benefits to replace lost wages during recovery.
  • Permanent partial or permanent total disability benefits in cases of lasting impairment.

Workers’ compensation benefits are designed to provide medical and financial support, though they do not compensate for pain and suffering. It is also important to note that claims typically must be filed within two years of the accident or the last compensation payment, making it essential to act quickly if you believe you have a claim.

Wrongful Death Act and Third-Party Claims

In some cases, additional claims may be available. For example, New Jersey’s Wrongful Death Act (N.J.S.A. 2A:31-1 et seq.) gives rights to surviving family members to recover financial losses.

In addition, where parties other than the direct employer may have contributed to negligent or unsafe conditions, a third-party claim may also be pursued. Under the New Jersey Workers’ Compensation Act (N.J.S.A. 34:15-1 et seq.), workers generally cannot sue their own employer for negligence, but they may hold other responsible parties accountable.

Depending on the facts of the case, third parties can include:

  • Property owners, if hazardous site conditions were a factor
  • General contractors or subcontractors, for failures in site supervision or safety oversight
  • Equipment or tool manufacturers, if defective products contributed to the accident
  • Maintenance or service companies, where inadequate inspection or repair caused unsafe equipment
  • Design professionals, such as architects or engineers, should identify if unsafe plans or designs lead to risk.

These claims are critical because they may provide compensation beyond what workers’ compensation covers, including damages for pain and suffering, loss of companionship (consortium), and other non-economic losses, depending on facts found in the investigation.

Common Workplace Injuries

While roofing and construction often involve working at heights, workplace injuries are not limited to falls.

Common job-site injuries include:

  • Traumatic brain injuries and other head injuries
  • Broken bones or spinal trauma from falls or impacts
  • Strains, sprains, or back injuries from overexertion
  • Crush or “struck-by” injuries from machinery or materials
  • Burns, electrical shocks, or chemical exposures
  • Long-term repetitive-stress injuries from vibration or repetitive motions.

Awareness of these risks, proper training, and adherence to safety standards remain critical in avoiding dangerous injuries and even deaths on the job.

Why Representation from a Personal Injury Attorney Matters

Suffering from a serious injury or workplace fatality can be emotionally exhausting, but having an experienced attorney to handle deadlines, filings, and negotiations allows families to focus on recovery and healing.

At Davis, Saperstein & Salomon, P.C. our role is not only to fight for compensation but also to support clients and their families through the legal process with compassion while they get the justice they deserve.

A New Jersey workers’ compensation attorney or New Jersey wrongful death lawyer can:

  • Ensure medical treatment and wage benefits are provided under workers’ compensation law
  • Protect legal rights under the New Jersey Workers’ Compensation Act
  • Investigate potential third-party claims to maximize recovery
  • Pursue wrongful death or Survivor’s Act claims where appropriate
  • Handle deadlines and complex filings so families can focus on their personal well-being.

Fatal Drunk Driving Crash Outside Elementary School in Newark, NJ

On July 27, 2025, two pedestrians were struck by a work van in front of George Washington Carver Elementary School in Newark, New Jersey, in a drunk driving hit-and-run. The Essex County Prosecutors’ Office has confirmed that one of the victims tragically lost their life, while the other suffered serious injuries. The driver, who was on the job at the time of the accident, fled the scene but later returned. Prosecutors have since charged him with multiple offenses, including first-degree vehicular homicide while driving under the influence in a school zone, leaving the scene of a fatal crash, and endangering an injured victim.

The drunk driver will inevitably be facing two types of legal prosecution: criminal prosecution and prosecution of a civil claim for money damages. In other words, he and his employer will be sued in the Superior Court of New Jersey, in what’s called a “Civil Action.” This is because the criminal justice system prosecutes crimes, and the civil justice system corrects harm and losses by recovering money.

At Davis, Saperstein & Salomon, P.C., this case hits close to home because our partner, Steven Benvenisti, Esq., knows firsthand the pain and devastation drunk driving can cause. As a college student, Steven was hit by a drunk driver while crossing the street and was left with severe, life-threatening injuries, including a traumatic brain injury and fractured legs. He was in a coma for ten days and remained in rehab and physical therapy for nearly a year. Miraculously, Steven survived, and even more, he thrived. His experience surviving a drunk driving crash motivated him to finish college and attend law school even after suffering a traumatic brain injury. Today, he has dedicated his professional life to advocating for and representing victims of drunk driving crashes and victims of others’ negligence.

When asked about the tragedy in Newark, NJ, Steven Benvenisti, Esq., stated:

“There is nothing more heartbreaking than a life lost, or a serious injury, caused by a drunk driver. Every drunk driving crash is a completely preventable tragedy. Sadly, in our country, we lose over 13,000 people every year due to drunk drivers, with hundreds of thousands being seriously injured. Behind every statistic is a family shattered, dreams cut short, and a community left grieving. We must never stop fighting for accountability, justice, and education to ensure that no one else ever has to endure this senseless pain.”

Every drunk driving accident is preventable. Every victim matters. And every family deserves justice.

These incidents cause serious heartbreak and lasting tragedy. If someone you love has died because of a drunk driver, or has been injured as a pedestrian, you have every right to be outraged, and you deserve justice. For over 40 years, Davis, Saperstein & Salomon, P.C. has built a reputation for results and compassion, recovering over $1 billion in verdicts and settlements for our more than 35,000 clients served. We understand the heartbreak of losing someone suddenly and senselessly, and we are here to help victims and their families, hold wrongdoers accountable.

Proving Liability in a Drunk Driving Accident Involving a Work Vehicle

Drunk driving cases with company vehicles add another layer of legal complexity to an already complex situation. When an employee causes harm on the job, the employer can often also be held legally responsible under the doctrine of vicarious liability. In this case, because the driver was on the job and driving a company-owned van, the employer may be legally liable for damages as well. This is a critical factor in pedestrian and wrongful death cases. New Jersey law allows victims to recover compensation, not only from the driver’s insurance but also potentially from the employer’s commercial liability coverage. Holding both parties accountable increases the chance of securing full and fair compensation.

Pedestrians have strict protection under New Jersey law. Drivers are required to yield to pedestrians in crosswalks (N.J.S.A. 39:4-35), not to drive while distracted or texting (N.J.S.A. 39:4-97.3), and never operate under the influence of drugs or alcohol (N.J.S.A. 39:4-50). When these basic laws are ignored, injuries or deaths often follow.

For families who have tragically lost a loved one, New Jersey’s Wrongful Death Act (N.J.S.A. 2A:31-1) allows them to seek compensation for the loss they suffered due to another’s negligence. The victims and their families have the legal right to pursue damages for:

  • Medical expenses and future care
  • Funeral and burial expenses in wrongful death cases
  • Lost income and financial support (if the person who died helped provide for the family)
  • Conscious pain, suffering, and emotional distress
  • Punitive damages if the death is alcohol related

The legal process can be emotional and exhausting, but you don’t have to go through it alone. Having a skilled New Jersey personal injury attorney on your side, someone who understands the legal system, the insurance tactics, and the emotional toll, can make all the difference in how you recover and rebuild.

How a New Jersey Personal Injury Lawyer Can Help

Recovering from a drunk driving accident or the loss of a loved one is overwhelming, dealing with grief, medical bills, legal confusion, and emotional trauma, all at once. Having an Essex County personal injury attorney or wrongful death attorney ensures that you have an advocate to fight for your best interests, so you can focus on healing. An experienced New Jersey drunk driving accident attorney will investigate the crash, preserve critical evidence like witness statements and police reports, and help determine the full value of your claim, so you don’t settle for less than you deserve.

Steven Benvenisti, Esq., is one of New Jersey’s most respected voices in drunk driving accident prevention and is a nationally known advocate for change. Not only has he dedicated his work to helping families and victims as a certified Civil Trial Attorney by the Supreme Court of New Jersey, but he went further, becoming the President of the

New Jersey Chapter of Mothers Against Drunk Driving, and the Co-Chairman of MADD National. Since his presidency, he has served on the National Board of Directors of Mothers Against Driving and has been an influential force in changing New Jersey and other jurisdictions’ laws to reduce the risk of injuries caused by intoxicated drivers. He is also an expert in brain injury cases, having suffered one himself, and has served as President of the Brain Injury Alliance of New Jersey.

Over the years, Steven has successfully represented clients in lawsuits involving pedestrian, wrongful death, and drunk driving injury cases, helping clients rebuild their lives, just as he once did. Alongside other attorneys at Davis, Saperstein & Salomon, P.C., he has secured life-changing results for those affected by drunk drivers. Below are a few of Steven’s and the firm’s most impactful drunk driving cases:

Steven’s story and passion for change only drive our firm’s commitment to hold drunk drivers accountable and seek justice for victims and their families.

What Happens If an Animal Causes a Car Accident?

Although many car crashes in New Jersey occur because of driver negligence, some accidents happen when motor vehicles collide with animals on the road. A driver may hit the brakes or swerve to avoid hitting an animal, which can cause them to lose control of the vehicle. Collisions with larger animals can cause significant vehicle damage and severe injuries to the vehicle’s occupants. People injured in animal-related car accidents may wonder about their legal options for obtaining compensation for car repairs, medical treatment, and lost income.

If you’re wondering what to do after a car accident caused by an animal, you’ve come to the right place. An experienced car accident attorney can help you figure out your options for moving forward. At Davis, Saperstein & Salomon, P.C., we’ve helped over 35,000 individuals and families get the justice they deserve. With over 40 years of experience, we’ve recovered more than $1 billion in verdicts and settlements.

Our team can investigate the accident and explore every possible avenue of compensation you could be entitled to. There’s no charge to meet with us, and we only get paid if we recover money for you.

Contact our New Jersey car accident attorneys today to get started.

Deer: The Most Frequent Cause of Animal-Related Car Accidents in New Jersey

Deer are among the animals that cause the most car crashes in New Jersey. New Jersey has a substantial deer population, especially in less densely populated areas of the state. According to animal car accident statistics from the New Jersey Division of Highway Traffic Safety, over 15,000 car crashes in New Jersey each year involve deer. Around half of these accidents occur from October through December as deer become more active during their mating season, and three-quarters of crashes occur during nighttime hours.

Does My Insurance Cover Animal-Related Car Accidents?

New Jersey has a no-fault car insurance system. Thus, you could seek compensation from your insurance policy after a car accident caused by animals. For instance, you could file a claim for personal injury protection (PIP) coverage. Every car insurance policy in New Jersey must include PIP coverage; insurers are required to offer a $250,000 limit as standard, although policyholders can opt for lower coverage limits. However, specific catastrophic injuries, such as spinal cord injuries, permanent brain damage, or disfigurement/dismemberment, qualify for $250,000 of coverage regardless of the purchased policy limit.

Furthermore, you may have purchased optional coverages in your car insurance policy that can provide compensation for other expenses. For example, collision/comprehensive coverage can help pay for repairs to your car or reimburse you for the car’s value if it is totaled in an accident. Rental reimbursement coverage can help cover the cost of a rental vehicle or alternative transportation expenses while your car is being repaired.

What To Do After a Car Accident Involving Animals

If you’ve been in a car accident caused by an animal, the steps you should take to pursue financial relief include the following:

  • Report the crash to your car insurance company and file a PIP claim to obtain reimbursement for medical expenses or lost income.
  • Obtain a copy of the police crash report if law enforcement comes to the accident scene.
  • Request copies of the medical records of your treatment and rehabilitation.
  • Follow your treatment plan and recovery instructions.
  • Gather your pay stubs/income statements if you miss work or experience a reduction in your earnings due to your injuries.
  • Keep all bills, invoices, and receipts of your accident expenses.

Finally, speak to an animal car accident attorney to explore your legal options for obtaining compensation. In addition to PIP coverage, you may have legal options against other drivers if they were negligent in responding to the animal’s presence on the road. For example, if a driver swerved into your lane to avoid hitting the deer, you could be able to seek additional money damages from them.

Community in Mourning After Child Killed and Three Injured in Oakland, NJ Pedestrian Accident

On the afternoon of July 24, 2025, a serious pedestrian accident at the intersection of Ramapo Valley Road and East Oak Street in Oakland, New Jersey, tragically killed one child and injured 3 others. According to the Bergen County Prosecutor’s Office, the four pedestrians, a mother and her three children, were walking through the crosswalk when they were hit by a vehicle. One child died as a result of the crash, and the other three pedestrians sustained injuries in this truly terrible and preventable accident. The Bergen County Prosecutor’s Office and the Oakland Police Department are still investigating the cause of the crash.

The attorneys at Davis, Saperstein & Salomon, P.C., extend our deepest condolences to the family and the entire Oakland community who were affected by this loss.

These types of tragedies are unfortunately not rare and are an example of how vulnerable pedestrians, especially children, are on our roads. If you or a loved one has been injured in a pedestrian accident or suffered the unimaginable pain of losing someone due to negligence, you are not alone, and you have come to the right place. Our New Jersey personal injury and wrongful death attorneys have over 40 years of experience fighting for justice. With more than 35,000 families helped and over $1 billion recovered in verdicts and settlements, we are committed to fighting for the justice you and your family deserve, so the focus is on healing during these difficult times.

What Causes Pedestrian Accidents?

Pedestrian accidents are completely preventable. These crashes are not just “accidents” that come out of nowhere; they happen when people have no concern for others and are being careless, reckless, or negligent while driving.

There is no reason that these accidents should happen, but some of the most common causes are:

  • Distracted Driving
  • Speeding
  • Impaired Driving (driving under the influence)
  • Poor Visibility (weather conditions, driving at night, or obstructed views)
  • Backing up without looking (like in driveways or parking lots)
  • Running red lights or stop signs
  • Turning without checking the crosswalk
  • Driving too close to sidewalks or shoulder areas

Every one of these situations can lead to disaster. And in nearly all cases, the driver could have made a better choice. When they don’t, and someone gets hurt or killed, they can and should be held accountable.

New Jersey Laws That Protect Pedestrians

New Jersey laws are very clear on pedestrian safety. N.J.S.A. 39:4-35 requires drivers to stop and yield to people crossing at both marked and unmarked crosswalks. This means that when someone is crossing the street at a crosswalk, cars must stop and let them pass safely. If drivers break this law, they can be fined, get points on their license, and be held legally responsible if someone is hurt or killed.

For families who lose someone in a crash, New Jersey’s Wrongful Death Act N.J.S.A. 2A:31-1 allows them to seek compensation for the loss they suffered due to another’s negligence. That means they can file a claim to get a settlement for expenses like:

  • Funeral and burial expenses
  • Loss of financial support (if the person who died helped provide for the family)
  • Conscious pain and suffering

These laws exist to hold drivers responsible when they put lives at risk and to protect everyone on the roads, both walking and driving.

Understanding Wrongful Death in Pedestrian Accidents

When someone is killed in a pedestrian crash, it’s not just an “accident,” it’s a wrongful death. These cases are heartbreaking, especially when children are victims. It leaves families grieving, trying to process their loss, and often feeling lost and like they don’t know where to turn or what to do next. The legal process is overwhelming, especially when you have just suffered a loss.

It’s important to know that you don’t have to go through it alone. While you focus on healing and taking care of your family, a New Jersey wrongful death attorney will focus on protecting your rights and fighting for justice.

A good lawyer will:

  • Investigate the accident – gather police reports, dashcam footage, and witnesses’ statements.
  • Work with experts – Medical professionals, accident reconstruction specialists, and others help us understand the full picture and determine fault.
  • Determine losses suffered – including current and future medical bills, pain and suffering, missed work, etc.

At Davis, Saperstein & Salomon, P.C., we work with families with care, respect, and experience. We’ve handled these cases for over 40 years, and we pride ourselves on handling all of our cases and clients with kindness and compassion and fighting hard to get results, because it’s more than just a case for us, and to you.

Over this July weekend, there were 3 drowning incidents in Wayne County, New Jersey, 2 of which were fatal. A 40-year-old man and a 5-year-old boy both tragically lost their lives, and a 19-year-old is currently in serious condition after being found in a pool unconscious.

These recent tragedies are being followed by the U.S. Consumer Product Safety Commission (CPSC) issuing a recall of millions of above-ground pools after at least 9 children tragically drowned. The recalled pools were sold under popular brands such as Bestway, Intex, and Polygroup, which have been sold for over two decades.

If you or a loved one has been injured because of a defective product or a drowning accident, you have come to the right place. You may be entitled to compensation for the damages caused by others’ negligence. Contact a personal injury lawyer as soon as possible to understand your options and start building your case. At Davis, Saperstein & Salomon, P.C., our priority is helping clients and their families understand their rights and protect themselves from losses caused by others’ negligence and carelessness.

Why the Recall?

The recalled pools have a design flaw that makes it easy for children to climb into the pool even if the ladder is removed. The compression strap that wraps around the pool and over the vertical poles acts like a ladder rung, allowing children to step up and get in the pool unnoticed.

Recalled Models:

  • Bestway & Coleman (2008–2024): Power Steel, Steel Pro
  • Intex (2002–2012): Metal Frame, Ultra Frame
  • Intex (2024–2025): Prism Frame, Ultra XTR Frame
  • Polygroup (2006–2025): Blue Wave, Funsicle, Sand n Sun, Summer Escapes, Summer Waves

Product Information:

  • Price range: $400 to $1,000
  • Retailers: Walmart, Target, Home Depot, Lowe’s, Costco, BJ’s, Sam’s Club, Sears, Big Lots, Amazon, Wayfair, manufacturer websites

Over 5 million of these pools have been sold since 2002, and many are still available for sale. If you think you own one of these models, check your pool immediately. The brand and model number are printed on the outside of the pool liner.

Common Causes of Drowning Accidents

In New Jersey, both property owners and product manufacturers have the legal duty to prevent drowning accidents, especially if they have children living there or nearby. Failure to follow safety standards, including having a secure pool barrier and safe pool equipment, can lead to devastating accidents, as seen in Wayne County, New Jersey.

Many of these tragedies happen when adults are by the pool or think it is safe, but a hidden product defect or poorly maintained property still allows access to the pool. In legal cases, establishing whether a defective product or negligence caused an accident is crucial in holding the right parties accountable.

Some common causes of drowning accidents are:

  • Unsafe pool equipment – ladders, drains, or recalled pools
  • Lack of supervision or barriers – unsecured gates or missing pool covers
  • Negligent maintenance – broken safety locks or fences
  • Poorly designed or recalled pools – like the recalled above-ground models

Pools can already be dangerous, but product defects can make a safe and secure pool a risk or even deadly. Children are at the highest risk of drowning, and these accidents can happen silently in seconds.

Injuries and Wrongful Death from Defective Products

Drowning accidents are unexpected and leave families with unimaginable emotional and financial burdens, especially when the victim is a child. Under New Jersey law, families who lose a loved one because of a defective product or someone’s negligence can file a wrongful death lawsuit to recover compensation for their pain and suffering. A wrongful death claim also allows families to hold negligent manufacturers or property owners legally responsible, improving safety and preventing future tragedies for everyone.

Families can seek compensation for financial and emotional losses caused by drowning accidents:

  • Medical treatment and rehabilitation
  • Funeral and burial expenses
  • Lost wages or loss of financial support
  • Pain, suffering, and emotional distress

Because these cases involve multiple defendants, working with an experienced New Jersey personal injury lawyer as soon as possible is critical to building your case.

Who Can Be Held Liable for Defective Products?

When a product causes injuries or even death, one or more parties can be held liable for their role in the negligence. Parties involved could be:

  • Manufacturer – poor safety testing
  • Retailers and Distributors – selling unsafe products, failing to warn customers, or not removing recalled items from shelves
  • Property Owners – failing to follow safety regulations or secure the pool
  • Online Sellers and Marketplaces – continuing to list recalled products

A New Jersey product liability or wrongful death attorney can investigate the incident and determine who was at fault so they will be held accountable for their negligence.

Injured? Call A New Jersey Personal Injury Attorney

In the past few years, there has been a major increase in product recalls. If you own any recalled or defective products, stop using them immediately and check if there’s a refund or alternative option from the manufacturer. If the product has already caused you harm, then contact an experienced New Jersey personal injury attorney to understand your legal rights and get the compensation you deserve for your pain and suffering.

At Davis, Saperstein & Salomon, P.C., we’ve spent over 40 years helping over 35,000 clients and their families recover from dangerous defective products, car accidents, wrongful deaths, workplace accidents, and other losses because of negligence. We have recovered more than $1 billion in verdicts and settlements to help our clients, and their families get back on their feet and move forward after being injured.

Partner at Davis, Saperstein & Salomon, P.C., former President of the New Jersey Association for Justice (NJAJ), and experienced New Jersey personal injury attorney, Adam Lederman, Esq. has successfully handled many product liability, drowning and wrongful death cases.

A father of two young boys, Adam knows how much these cases affect families. Drowning cases are particularly difficult given the age of the child and working to help people understand just how horrifying the experience of drowning is for the victims. Adam has worked with several medical experts to help bring these losses to life for his clients. Adam has been quoted as saying, “every family and every loss is personal – clients deserve to have their story told.”

Some of the most impactful defective product, drowning and wrongful death cases handled by Adam Lederman, Esq. are:

  • $6,000,000+ child drowning case
  • $4,500,000 brain injury case
  • $3,000,000 wrongful death case
  • $3,000,000 pedestrian vs. police cruiser collision
  • $1,000,000 wrongful death case (full available insurance coverage limits)

Fatal Motorcycle Accident in Little Falls, New Jersey Highlights the Dangers of Illegal Left Turns

A motorcycle crash in Little Ferry, New Jersey, has left a family and community grieving the loss of a young man. On Tuesday, July 2, a 25-year-old motorcyclist was traveling southbound on Bergen Turnpike when he was struck by a car making an illegal left turn across a double yellow line.

According to Little Ferry Police, the crash occurred late at night when the driver of a car attempted to turn left into a laundromat parking lot, directly cutting through the motorcycle’s path. The rider suffered critical injuries and was rushed to Hackensack University Medical Center, where he tragically passed away on Saturday, July 5. This heartbreaking motorcycle accident was caused by negligence and was entirely preventable. When drivers violate motor vehicle laws, they end up putting those that legally share the roadway in danger. This is especially true when they disrespect or ignore the rights of motorcyclists because they have little outer physical protection and the consequences can be deadly.

Too often people are biased against motorcyclists, thinking that they assume the risk of serious injury merely by operating a motorcycle. This is fundamentally wrong because motorcycle operators are fully entitled to ride their motorcycles on all roadways with the expectation that other drivers will yield the right of way and obey all motor vehicle laws.

But motorcycle operators do have legal rights that hold negligent drivers accountable for their careless driving by suing them in a court of law. Our legal advice is to hire a good personal injury lawyer who’s an expert in handling motorcycle accident cases with a proven track record. Our attorneys at Davis, Saperstein & Salomon P.C. will help you understand your rights, guide you through the claim, and fight hard for the justice and compensation you and your family deserve. We have a proven 40-year track record of knowledge, experience, and expertise in representing injured motorcycle drivers and motorcycle passengers.

Illegal Left-Turns in Motorcycle Accidents

Left turn crashes are one of the deadliest accidents for motorcyclists. According to the National Highway Traffic Safety Administration (NHTSA) traffic safety facts, 44% of fatal two-vehicle motorcycle accidents occur when a car makes a left turn in front of an oncoming motorcyclist. These crashes mostly happen when a motorcyclist has the right of way, and when the other driver doesn’t see them, misjudges their speed, or breaks the law, like turning across a double yellow line. The result of negligence too often is life-changing.

In New Jersey, the traffic laws are clear that it is illegal to make a left turn when faced with oncoming traffic. In that situation, drivers must yield the right of way to a car or motorcycle traveling straight. These laws protect all drivers from tragic accidents like the one in Little Falls, New Jersey, but they are especially important for motorcyclists.

Motorcycle Wrongful Death Claims in New Jersey

When a motorcyclist is killed due to another driver’s carelessness, negligence, or because they broke the law, the family has the right to file a wrongful death claim in New Jersey. This helps families recover money for financial and other losses they suffered after losing a loved one, especially if the accident was preventable.

New Jersey’s Wrongful Death Act (N.J.S.A. 2A:31-1) allows close family members like the spouse, children, or parents to bring a claim against the person, people, or parties responsible for the accident and death. The claim can include:

  • Funeral costs
  • Medical bills from the accident
  • Lost income the deceased would have provided
  • Loss of companionship

Motorcycle wrongful death cases are especially challenging, and they require careful and thorough investigation to prove fault. An experienced New Jersey motorcycle accident attorney will gather critical evidence like police reports, crash scene photos, police body cam, and other video footage that proves the cause of the accident.

What Steps Should I Take After a New Jersey Motorcycle Accident?

The aftermath of a serious motorcycle accident is overwhelming, but the most important thing to do first is obviously to seek medical attention. This should always be the first priority, but the steps you take early on can have a big impact on your health, your case, and your future.

For that reason, if you have been involved in a motorcycle crash in New Jersey, you should personally or have a close friend or family member protect your legal interests by hiring a motorcycle accident lawyer who will worry about winning your case while you heal from your wounds. They will:

  • Investigate and reconstruct the motorcycle accident.
  • Lock down valuable evidence.
  • Hire Accident reconstruction experts.
  • Preserve valuable video footage.
  • Secure and perhaps amend the official accident report.
  • Interview eyewitnesses or anyone else involved in the accident.
  • Take photos of the scene, injuries, and any other property damage.
  • Protecting you from giving any recorded statements or speaking to insurance companies.
  • Helping hospitals and doctors get their medical bills paid.

The sooner you start working with a New Jersey motorcycle accident lawyer, the better. They will help preserve evidence, gather important documentation, and protect your case before any important legal deadlines are missed.

You Have the Right to be Angry and Take Legal Action

Suffering major injuries or losing a loved one in a New Jersey motorcycle accident is incredibly painful. Especially when these accidents are caused by negligence and carelessness, the grief is made worse because often it is understandably paired with anger.

Often, the negligent driver makes a statement quoted in the official police report, wrongfully blaming the motorcyclist. But you need to know that you can get justice by suing the car, truck, or bus driver who injured you. Under New Jersey state law, you can sue for your past, present, and future physical and emotional injuries, plus financial losses caused by the accident.

Motorcycle personal injury accident claims are never as simple as they seem, especially when there is a death involved. Victims of these accidents should never assume they don’t have a case. They should contact a skilled motorcycle accident attorney to explore all possible contributing causes of the collision.

No family should be left alone picking up the pieces after a crash. No negligent driver should walk away without being held responsible. A skilled and experienced New Jersey Personal injury motorcycle accident attorney will help guide you through the complex legal process and get you the justice and compensation you deserve.

  • A $1,815 million settlement by a passenger on a motorcycle.
  • A $489,526 settlement for a motorcyclist struck by a car making a left-hand turn.

9 Killed in New Jersey Auto Accidents Over the 4th of July Weekend

This year, New Jersey’s Fourth of July was more of a devastation than a celebration for some families. According to the New Jersey State Police, 9 people died in separate motor vehicle accidents across five different New Jersey counties between Friday morning and Sunday night. Sunday alone accounted for 5 of the fatal auto accidents, making it the deadliest day of this holiday weekend.

Holidays like the Fourth of July are meant for fun times making memories with friends and family, but we often forget the dangers that come with traveling and traffic. Lives can change quickly once out on the road, and some of these negligent and careless accidents leave families and communities in grief. These car crashes are preventable, and when someone is hurt or killed due to the negligence of another driver, New Jersey State Laws allow victims and their families to pursue compensation through a personal injury or wrongful death claim.

At Davis, Saperstein & Salomon, P.C., our attorneys have been helping injured motorcyclists and grieving families for over 40 years. With more than $1 billion recovered in verdicts and settlements for our over 35,000 clients, we know how devastating these accidents can be and how hard it is to know what to do next.

If you or someone you love has been injured or killed in a motorcycle accident, we’re deeply sorry for what you’re going through. You don’t have to face this alone, you have come to the right place for help. Our experienced and skilled team is here to guide you through the legal process, help you understand your rights, and fight for the justice and compensation you and your family deserves.

Holiday Driving in New Jersey

Holiday weekends are one of the most dangerous times to be on the road in New Jersey. According to the Insurance Institute for Highway Safety (IIHS), July 4th is typically one of the days of the year with the most motor vehicle crash deaths. The heavy traffic on holidays like Memorial Day, July 4th, and Labor Day, when paired with alcohol, fatigue, hot temperatures, and distracted driving all contribute to a preventable tragedy. To stay safe during the holiday trip, remember to:

  • Avoid driving late at night or at peak driving hours
  • Never drive under the influence of alcohol or drugs
  • Designate a sober driver or use a rideshare service
  • Stay off your phone while driving and stay alert to prevent distracted driving
  • Wear your seatbelt
  • Slowdown in high-traffic areas and construction zones

Staying alert, patient, and prepared can make a big difference in preventing these devastating accidents. If you or a loved one has recently been involved in a holiday motor vehicle accident in New Jersey, reach out to a trusted New Jersey car accident lawyer to understand your legal options.

Some common injuries in motor vehicle accidents are:

  • Back, neck, and spinal cord injuries
  • Broken bones and Fractures
  • Lacerations, burns, scarring, and road rash

An experienced and skilled New Jersey Personal Injury attorney will make all the difference in your case. • Communicate with insurance companies.
  • Gather medical records and proof of damage and losses.

Free Legal Guide and Advice from Davis, Saperstein & Salomon, P.C.

When multiple devastating accidents occur in such a short span of time, it raises important questions about fault, negligence, and liability. Was the other driver distracted? Were they speeding? Everyone deserves to know what really happened.

The attorneys at Davis, Saperstein & Salomon, P.C. have been answering these questions for over 40 years and have helped more than 35,000 clients recover the money they needed to get their lives back on track. Motorcyclist Injured in Cliffside Park, New Jersey

On Sunday evening, June 29, 2025, a motorcycle accident at the intersection of Edgewater Road and Anderson Avenue in Cliffside Park, New Jersey, sent a motorcyclist to the hospital with serious injuries. According to police reports, the crash occurred when a vehicle and a motorcycle collided in the middle of the intersection, and eyewitnesses reported that the crash was forceful enough to throw the rider from his bike.

Once the first responders from the Cliffside Park Police Department and local EMS units arrived on the scene, the rider was rushed to a nearby trauma center with serious injuries. The intersection was closed for several hours as the Cliffside Park police and the Bergen County Fatal Accident Task Force investigated the crash to find out if any traffic violations or negligence could have played a part.

Motorcycle accidents like this one can leave behind serious physical, emotional, and financial challenges caused by others’ negligence. If you or someone you love has been injured in a crash, you’ve come to the right place. At Davis, Saperstein & Salomon, P.C., we understand what you are going through and are here to help. While you focus on healing, we’ll focus on investigating the accident, protecting your rights, and fighting for the justice and compensation you deserve to get back on your feet…and even on the road.

Common Motorcycle Accident Injuries

Motorcycles have little protection for riders in crashes. Without the steel frame, seatbelts, or airbags that protect drivers and passengers in passenger cars, motorcyclists are vulnerable to injuries on impact with other vehicles, the road, and any other objects near the street. Even when wearing a helmet, motorcyclists can suffer severe injuries from what could have been a minor car accident.

In the Cliffside Park crash, officials have not released details about the motorcyclist’s injuries, but common injuries in motorcycle accidents are:

  • Traumatic brain injuries (TBIs), concussions
  • Fractured bones
  • Spinal cord injuries, including ruptured or herniated disks
  • Abrasions, road rash, scars, other lacerations
  • Facial and dental injuries
  • Emotional trauma (PTSD)

While some injuries are immediately obvious, others, like head, spine, or internal organ injuries, may not appear until hours or even days later. That’s why victims should always be seen by a doctor, even if they don’t feel hurt after a crash.

Common Causes of Motorcycle Accidents in New Jersey

Motorcycle crashes like the one in Cliffside Park are often caused by a mix of different factors. Unlike cars or trucks, motorcycles are smaller and harder to spot, especially at busy intersections or when drivers are distracted.

Some of the most common causes of motorcycle accidents in New Jersey include:

  • Driver’s inattention or disrespect of the motorcyclist’s right of way
  • Drivers making left-hand turns across the path of an oncoming motorcycle
  • Unsafe lane changes
  • Speeding or distracted driving
  • Bad weather conditions, like rain or fog, that reduce visibility and traction
  • Hazardous roadways, including potholes, loose gravel, or uneven pavement
  • Poor signage or traffic signals at intersections
  • Injuries to motorcycle passengers

Unfortunately, it’s usually the motorcyclist who suffers the most serious injuries, which is why it’s critical to investigate crashes and hold all negligent drivers accountable.

What Does a Motorcycle Accident Attorney Do?

After an accident, one step to avoid is dealing with insurance companies. This can be one of the most complex parts of a case because motorcycle riders face more insurance challenges because they are treated differently from passenger cars. For example, motorcycle insurance policies in New Jersey do not offer Personal Injury Protection (PIP). This means that motorcyclists cannot rely on PIP coverage for their medical expenses or lost wages, so they would need to find compensation through other channels, such as the at-fault driver’s liability insurance or their own health insurance. The process isn’t always straightforward and depends on the accident, especially if the other driver’s insurance tries to blame the motorcycle operator or minimize the extent of the injuries caused by the accident.

That’s where an experienced New Jersey motorcycle accident attorney comes in. Beyond handling paperwork, a skilled attorney will uncover the true factors of what happened, push back against unfair insurance, and fight to get you the compensation you deserve.

A motorcycle accident attorney will:

  • Investigate the accident scene, interview witnesses, and gather the full police report and any body cam videos under the New Jersey Freedom of Information Act.
  • Identify all responsible at-fault parties that contributed to the accident.
  • Communicate with insurance companies.
  • Gather medical records and proof of damage.
  • Help clients recover from their injuries, money for medical expenses, lost income, property damage, and pain and suffering.
  • Negotiate a fair settlement for your claim.

Motorcycle personal injury accident claims are never as simple as they seem, so motorcycle accident victims should never assume they don’t have a case, but should contact a motorcycle accident attorney to explore their options first. At New Jersey’s personal injury law firm, Davis, Saperstein & Salomon, P.C., we have seen firsthand how devastating these crashes can be, and we know how to build a strong case that covers the full scope of your injuries and losses.

Protecting Your Rights After an Accident

Accidents like the one in Cliffside Park raise important questions about fault, negligence, and liability. Was the other driver distracted? Were they speeding? Was the driver working when the accident happened? Was there insurance coverage, and if so, how much? Everyone deserves to know what really happened.

  • $1.05 million for a motorcyclist struck by a King Mack truck.

When asked about the accident in Cliffside Park, NJ, Garry stated, “My advice to recent motorcycle accident victims is to not delay in hiring the right lawyer so they can start getting the facts of your claim straight and get ahead of legal deadlines so you can receive the maximum compensation you deserve.”
